Is there a criminal attorney in the house?

Defendant is 70, with some felony priors dating back decades. Driven to desperation he stole a ladies credit card. She left it in the ATM, the opportunity presented itself. What he did was horrible enough indeed, even if he did not physically take the card from her.
He is at this moment expecting the law to show up because they have him on camera taking the card, and using it to purchase gas. He does not plan to fight the charges.
What might he expect to happen and when?

He might go to jail like a younger repeat offender.
He should go to the police station, turn in the card, and offer to make restitution for his brief lapse in judgment. Waiting until the law shows up makes it worse.
He may end up charged with a misdemeanor but if his felonies are as old as you say, he might get off easy with a fine and some probation.
